NJDEP Announces Land Use Regulation Updates

Trenton, NJ – May 27, 2024

Similar to the July 2023 changes to statewide Flood Hazard Area and Stormwater regulations, the NJDEP is proposing regulatory reforms to assist New Jersey communities adapt to sea-level rise and extreme weather.

NJDEP’s rule proposal, known as “Resilient Environments and Landscapes” (REAL), is designed to address the current and future impacts of a changing climate.  Regulatory rules proposed for modification include:

  • Coastal Zone Management Rules
  • Flood Hazard Area Control Act Rules
  • Freshwater Wetland Protection Act Rules
  • Stormwater Management Rules

The proposed formal rule is expected to be published in the New Jersey Register in July 2024, with a 90-day public comment period commencing on the date of publication.  The anticipated adoption of the proposed rule is in the Fall of 2025.

These rule modifications will have significant bearing on the land development community.  CP Engineers, Architecture & Environmental Services is reviewing a pre-published release of the proposed rule updates to be at the forefront of these dynamic regulatory changes for our clients.
